Overview

Chuck Armgardt has over twenty-five years of litigation experience in the courts of New Mexico and the Southwest.  His practice is focused on commercial disputes, with concentrations in intellectual property, trade practices, oil and gas, eminent domain and condemnation, employment, defamation, and professional liability.

In addition to litigation, Chuck has substantial background and experience in trademark searches and registrations, intellectual property transactions, and attorney ethics.  For over fifteen years, Chuck has served as Ethics Attorney and Loss Prevention Partner of Modrall Sperling, and he is Regional Loss Prevention Coordinator for Attorneys' Liability Assurance Society (ALAS). 

Chuck is rated "AV"® by Martindale Hubbell, which is the highest ranking conferred.  He also is included in Best Lawyers in America® in Commercial Litigation and Southwest Super Lawyers®.

Chuck enjoys camping, fishing, skiing, golf, and spending time with his family.

  • Defeated claims of breach of employment contract and misuse of name/persona, in Sisneros v. Citadel Broadcasting, N.M. District Court, N.M. Court of Appeals, 2005-NMCA-102, 140 N.M. 266, 142 P.3d 34. 

  • Co-counsel in defeat of class-action natural gas royalty underpayment claim in San Juan 1990-A v. El Paso Prod. Co. and Amoco Prod. Co , N.M. District Court and N.M. Court of Appeals, 2002-NMCA-41, 132 N.M. 73, 43 P.3d 1083. 

  • Defended class action natural gas royalty underpayment claim in Parry v. Amoco, Colorado District Court.

  • Brought trademark inter partes proceeding in Lovelace Scientific Resources v. Lovelace Healthcare Innovations , U.S. Trademark Trial & Appeal Board.

  • Successfully brought holdover franchisee trademark infringement claim in K-Bob's v. Lee Cattle Co., U.S. District Court N.M.

  • Procured release of newsworthy depositions for newspaper in Doe v. Archdiocese , N.M. District Court, N.M. Court of Appeals, 1996-NMCA-94, 122 N.M. 307, 924 P.2d 273.

  • Co-counsel in defeat of legal malpractice claim in RTC v. Fulbright & Jaworski , U.S. District Court, U.S. Tenth Circuit, 74 F.3d 218.

  • Obtained judgment for infringement of Native American designs in Southwest Products v. DeJuno , U.S. District Court.
