Overview

Jennifer Anderson's practice is focused on products liability, employment, class actions, mass torts, insurance, healthcare and commercial litigation. She regularly advises businesses and individuals on issues related to employment disputes, contracts, negotiations, medical malpractice, product safety, professional liability, and fair debt collection practices. She has appeared in state and federal courts, and regularly participates in arbitrations and facilitations.

Jennifer provides counsel and litigation support for clients including pharmaceutical companies, medical suppliers, medical service providers, national retail corporations, school districts, and insurance companies. In addition, she served as trial counsel in pro bono cases, including an intellectual property case for a large, non-profit medical services provider and small family related issues.

Experience

  • Successfully represented a large national retailer in a wage and hour class action. Coordinated the discovery efforts, which included obtaining thousands of boxes of documents from dozens of sources across the state and maintaining a document production facility housing those documents.

  • Represented a multi-state provider of medical malpractice insurance as coverage counsel, overseeing several medical malpractice cases.  Additionally, served as trial counsel for the carrier in two significant coverage disputes and in a regulatory dispute with the State of New Mexico.  Donald J. Ham and Alamogordo Eye Clinic v. American Physicians Assurance Corp., Case No. No. 08-CV-00638-PJK-RHS in the United States District Court for the District of New Mexico; Stephen H. Haynes and American Physicians Assurance Corp. v. Morris J. Chavez, in his official capacity as Superintendent of the N.M. Dept. of Insurance, Case No. D-905-CV-2009-00697 in the Ninth Judicial District Court of New Mexico; and Marilyn Bush and John Bush v. American Physicians Assurance Corp. and Michael Demers, No. CV 2009-02265 in the Second Judicial District Court of New Mexico.

  • Represented large public and private employers in litigated and non-litigated employment matters, including matters involving the following types of claims:  Title VII, ADA, ADEA, New Mexico Human Rights Act, defamation and breach of contract.

  • Served as trial counsel for pharmaceutical companies and manufacturers of dietary supplements and medical devices in products liability litigation.  Products include many different prescription and non-prescription medications, surgical staplers, insulin pumps and other non-medical products.

  • Served as trial counsel in class actions and individual claims for creditors and collection agencies under Fair Debt Collection Practices Act and Fair Credit Reporting Act.

  • Served as trial counsel for larger private and public entities in significant personal injury cases.

  • Represented public and private entities in sensitive matters, developing crisis management plans and strategies for handling media inquiries.
